Chapter One: Introduction

1.1 Background of the Study
Persons with disabilities (PWDs) in Nigeria face numerous challenges, despite the constitutional guarantees aimed at ensuring their rights and protections. The Nigerian Constitution, along with various international agreements like the Convention on the Rights of Persons with Disabilities (CRPD), mandates that PWDs should enjoy equal rights and opportunities in society (Olufemi & Dada, 2024). In Maiduguri Metropolitan Local Government Area (LGA) in Borno State, PWDs often struggle with limited access to education, healthcare, and employment, which undermines their full participation in society. This study seeks to examine the effectiveness of constitutional provisions designed to protect the rights of PWDs, particularly focusing on local government efforts and the actual impact of such protections on their lives in Maiduguri.

1.2 Statement of the Problem
Although the Nigerian Constitution includes provisions aimed at protecting PWDs, these legal frameworks are often poorly enforced at the local government level. In Maiduguri, PWDs face significant barriers in accessing public services, employment, and education, often due to social stigma, physical infrastructure limitations, and inadequate implementation of laws. This study aims to investigate how constitutional protections for PWDs are being implemented and the challenges that hinder their effectiveness.

1.3 Objectives of the Study

  • To assess the effectiveness of constitutional protections for persons with disabilities in Maiduguri Metropolitan LGA.

  • To identify the challenges faced by PWDs in accessing constitutional rights and services in Maiduguri.

  • To recommend strategies for improving the enforcement of constitutional provisions for PWDs in Maiduguri Metropolitan LGA.

1.4 Research Questions

  • How effectively are constitutional protections for persons with disabilities enforced in Maiduguri Metropolitan LGA?

  • What are the primary challenges faced by PWDs in Maiduguri in accessing their constitutional rights?

  • What measures can be implemented to improve the protection and rights of persons with disabilities in Maiduguri?

1.5 Research Hypothesis

  • H₁: Constitutional protections for persons with disabilities are inadequately enforced in Maiduguri Metropolitan LGA.

  • H₂: The lack of accessible infrastructure and social stigma are key barriers to the full enjoyment of rights by PWDs in Maiduguri.

  • H₃: Enhancing local government enforcement mechanisms will improve the quality of life for persons with disabilities in Maiduguri.

1.6 Significance of the Study
This study will provide critical insights into the implementation of constitutional protections for persons with disabilities, with a specific focus on Maiduguri. It will serve as a resource for local governments, advocacy groups, and policymakers to better understand the challenges PWDs face and the gaps in legal enforcement. By providing actionable recommendations, the study aims to contribute to the empowerment and integration of PWDs into society.

1.7 Scope and Limitations of the Study
The study will focus on persons with disabilities in Maiduguri Metropolitan LGA, Borno State. It will examine the implementation of constitutional protections as well as local government policies. Limitations include potential difficulties in reaching a diverse sample of PWDs due to the sensitivity of the subject and possible reluctance to participate.

1.8 Operational Definition of Terms

  • Persons with Disabilities (PWDs): Individuals who have physical, mental, or sensory impairments that limit their full participation in society.

  • Constitutional Protections: Legal safeguards provided by the Nigerian Constitution to protect the rights and welfare of citizens, including PWDs.

  • Enforcement: The act of ensuring the effective implementation and adherence to legal rights and protections.
